Penal Code of 10 April 1960.

Article 321.  A woman who through any means performs an abortion on herself or consents to another person applying such means shall be punished with six months’ to three years’ imprisonment.

Article 322. 

(1)  Whoever by any means performs an abortion on a woman with her consent shall be punished with one to three years’ imprisonment.

(2)  If the abortion or the means employed for it result in the death of the woman, the perpetrator shall be punished with a minimum of five years’ hard labor.

Article 323. 

(1)  Whoever intentionally performs an abortion on a woman without her consent shall be punished with up to ten years’ hard labor.

(2)  The punishment shall not be less than ten years if the abortion or the means employed for it result in the death of the woman.

Article 324.  A woman who performs an abortion on herself in order to save her honor shall benefit from a mitigation of punishment. Similarly, a person who performs any of the acts described in Articles 322 and 323 in order to preserve the honor of a descendant or a relative to the third degree shall benefit from the same mitigation..

Article 325.  If the perpetrator in this section is a physician, surgeon, apothecary, or midwife, the punishment provided for shall be increased by one-third.

Article 12 prohibits physicians from providing advice on abortion or from performing an abortion except when necessary to prevent a threat to the life or health of the pregnant woman. The abortion must be performed in a hospital with the consent of the pregnant woman or of her husband or guardian if she is unable to write or speak.  Licensed physicians or specialists must certify that the abortion is necessary and records of the abortion must be maintained for ten years.

أ-  يحظر على أي طبيب وصف أي شيء بقصد اجهاض امرأة حامل او اجراء عمليه اجهاض لها ، الا اذا كانت

عملية الاجهاض ضرورية لحمايتها من خطر يهدد صحتها او يعرضها للموت وعلى ان يتم ذلك في مستشفى شريطة

توافر ما يلي :- 

1-موافقة خطية مسبقة من الحامل باجراء العملية وفي حالة عدم مقدرتها على الكتابة او عجزها عن النطق تؤخذ

هذه الموافقة من زوجها او ولي امرها 0

2-شهادة من طبيبين مرخصين ومن ذوي الاختصاص والخبرة تؤكد وجوب اجراء العملية للمحافظة على حياة

الحامل او صحتها 0

3-تضمين قيود المستشفى اسم الحامل وتاريخ اجراء العملية ونوعها والاحتفاظ بالموافقة الخطية وبشهادة

الطبيبين لمدة عشر سنوات على ان تزود الحامل بشهادة مصدقة من مدير المستشفى باجراء هذه العملية لها 0

ب- على الرغم مما ورد في قانون العقوبات ، لا تلاحق الحامل والشخص او الاشخاص الذين اجروا او اشتركوا في

 اجراء عملية الاجهاض لها وفقاً لاحكام الفقرة (أ) من هذه المادة بتهمة اقتراف جريمة الاجهاض 0
