Staatssecretaris Bussemaker en Minister Hirsch Ballin lichten Tweede Kamerleden verkeerd voor over de overtijdbehandeling (OTB), de wijziging van het Besluit Afbreking Zwangerschap (BAZ) en de strafbaarheid van de OTB door Women on Waves.

Women on Waves stelt dat de Staatssecretaris op 24 augustus en 4 september kamervragen van Van Miltenburg en Teeven, Sap en Gill’ard en Heerts onjuist heeft beantwoord. Op haar website geeft Women on Waves in 12 punten een uitgebreide toelichting (www.womenonwaves.org/article-2112-en.html)
Onderstaande de belangrijkste kritiekpunten samengevat.

1. Foute en misleidende uitleg van de huidige abortuswet door bewindslieden

De verkeerde voorlichting van de bewindslieden is gerelateerd aan hun foute en misleidende uitleg van de abortuswet (Wet Afbreking Zwangerschap = WAZ). Deze wet kent meerdere artikelen. Artikel I van de WAZ regelt voorwaarden voor abortushulpverlening, Artikel II bevat het strafwetsartikel 296 dat zwangerschapsafbreking zonder vergunning strafbaar stelt. Zwangerschap heeft in het eerste en tweede artikel een zelfde definitie, namelijk als een vrouw meer dan 16 dagen over tijd is.
De bewindslieden doen nu plotseling alsof er twee verschillende wetten zijn en hanteren twee zwangerschapsdefinities. Zij erkennen dat de overtijdbehandeling (OTB, behandeling voor 16 dagen over tijd) niet onder artikel I valt. Tegelijkertijd stellen zij dat deze behandeling wel onder artikel II (dus de strafwet) valt, hetgeen onjuist en juridisch onmogelijk is.
Als gevolg van deze misleidende redenering stellen de bewindslieden ten onrechte dat huisartsen momenteel de OTB niet zonder vergunning mogen uitvoeren. Ook stellen zij dat Women on Waves (WOW) de OTB momenteel niet zonder WAZ-vergunning in internationale wateren mag uitvoeren. Beide stellingen van de bewindslieden zijn juridisch onjuist en onhoudbaar.

2. Bewindslieden gaan voorbij aan jurisprudentie en uitspraken van voorafgaande bewindslieden

Zowel de Hoge Raad als de Raad van State hebben gesteld dat de OTB niet onder de WAZ valt met als consequentie dat voor deze behandeling geen WAZ vergu...

In Argentina abortion is illegal in most cases. There are about 500,000 abortions per year, most of them clandestine. About 68,000 women enter the public hospitals each year with post-abortion complications, and annually around 100 of these women die.
The goal of the hotline, “Abortion: more information, less risks” is to democratize access to information on the correct way to have a safe abortion using misoprostol.

The use of medicines to carry out safe abortions exists for more than twenty years as an established practice and is recommended by the World Health Organization and other agencies for its efficacy and low risk of death and complications when used correctly. Abortion using the medicine misoprostol is recommended by the World Health Organization as safe until the 12th week of pregnancy. There is no need for hospitalization; it involves little risk, with minimum subsequent medical care, equal to that following a miscarriage.

The Health Equity and Law Clinic of the University of Toronto wrote the following letter for Google together with Women on Waves. It concerns the recent Google policy to restrict adds for abortion related information and services in certain countries.

We are writing on behalf of Women on Waves (“WOW”), a non-profit organization providing health services and sexual education to prevent unwanted pregnancy and unsafe abortions, and the Health Equity and Law Clinic, Faculty of Law, University of Toronto, an academic clinic specializing in reproductive and sexual health law and policy. This letter concerns a change to Google Adwords policy respecting the advertising of abortion services.

On September 17, 2008, WOW received notice of a Google AdWords Advertising Policy Update (“Revised Policy”).1 Under the Revised Policy, Google AdWords will:

no longer accept ads that promote abortion services and that target any of the following countries: Argentina, Brazil, France, Germany, Hong Kong, Indonesia, Italy, Malaysia, Mexico, Peru, Philippines, Poland, Singapore, Spain, or Taiwan. 'Abortion services' include, but are not limited to, abortion clinics and abortion counselors.

While we acknowledge much consideration was given to your decision on the advertising of abortion services and the potential effect of the Revised Policy, we request the policy be reviewed for the following reasons:

• 1. The effects of the Revised Policy for persons other than Adwords advertisers. We are concerned about the adverse effect of the Revised Policy for women seeking safe and lawful abortion services. By restricting access to information, the Revised Policy may contribute to unsafe abortion in a manner inconsistent with human rights principles.

• 2. The justification for the Revised Policy. We understand that Google may refuse or terminate any advertisement at any time and for any reason. Given the adverse impact of the Revised Policy on human rights to safe abortion, a reasoned justification in this instance is warranted but lacking.

We believe these reasons merit the rescission of the Revised Policy.

The European Court of Human Rights ruled today that article 10, that guarantees the freedom of expression, was violated when the Portuguese government send warships to prevent the Women on Waves ship from entering Portugal in 2004. With a ship, Women on Waves sails to countries where abortion is illegal. After sailing to international waters, early medical abortions can be provided safely and legally. National penal legislation, and thus also abortion laws, extends only to territorial waters; outside that 12-miles radius the law of the country where the ship is registered applies. Women on Waves’ mission is to prevent unsafe abortions and empower women to exercise their human right to physical and mental autonomy. Every year 20 million women resort to unsafe abortion services as a result of which 70.000 women die unnecessary.

The purpose of the ships visit to Portugal was to call attention to the consequences of illegal abortion, to give information and sexual health education and to catalyze change of the restrictive abortion law. Women on Waves has visited Spain from October 16 till 21 at the invitation of 33 Spanish organisations concerned with a better abortion law. In Spain, abortion is only legal when case the pregnancy poses a threat to the physical or mental health of the woman, or in case of rape or fetal malformations. Every year approximately 100.000 abortions take place in Spain, once a psychiatrist has determined that the woman's mental health is endangered.
The major of Valencia, Rita Barberá, denounced the ship’s visit as a provocation.
More than 500 people attended the manifestation to celebrate the arrival of the ship even though police imposed a last minute ban on the artistic and musical parts of the manifestation. The Dutch parliamentarian Chantal Gill’ard of the Socialist party and the Spanish actrices Isabel Requena Pallares and Pilar Bardem addressed the crowds.
Outside the harbor some anti abortion rights groups protested loudly but they failed to fulfill their promise to prevent the ship from entering the harbour.
The boat was able to sail out to international waters with several women. Outside the spanish territorial waters the women on board could get a safe, medical abortion. It showed that many women are falling through the cracks of the system currently in place, For many women the private clinics are too expensive, other women are too young and cannot get parental consent, are immigrants, and/or live far from clinics and cannot travel.
